The responsibility of the Ecuadorian state, to children and adolescents, is to respect the fundamental right of the interests of the child as enshrined in the Constitution of the Republic of Ecuador in Article 44. The responsibility is to prevent and prosecute, through the legal and administrative remedies provided by law, effectively and timely the violations of the rights of children and adolescents is crucial, so that they and they can demand and obtain from the authorities and public and private appropriate authorities, urgent protection measures, and above all ensure food and resources for their care and protection. The proposed change is to ensure the right to food of this priority care group subject to the best interests of children and adolescents should prevail in all states; however, despite the perfection of the law in practice it is not met, being in many cases these children and mothers defenseless. The non-application of these laws is what is intended to banish, because we already know the dire consequences, and we must participate all natural and legal entities involved in this change with proposals to frame that exists in the country a culture of responsibility all actors. Comply with and enforce the law must be the watchword of authorities and constituents, and on this issue in the present research work to respect and guarantee the payment of alimony
