Tag hinzufügen | Zusammenfassung: | This degree thesis is entitled: "Jurisprudential and doctrinal analysis of virtual guilt in Ecuadorian civil law" its importance to develop is due to the realization of a study given virtual guilt as a normative element to strengthen the protection of the rights of citizens. They are defenseless by not being able to demonstrate the causality of the facts they impute against a professional who performs his work without professional ethics. This malpractice of work causes severe and disproportionate damage to rights. The study shows that proving this causality by users, who receive damage, is complex since they do not have the necessary means to demonstrate the alleged facts based on objective evidence. This research aims to reform the standard to include virtual guilt to safeguard constitutional rights. For this purpose, applying methods and techniques allowed a doctrinal and legal study. Surveys and interviews with legal professionals were also carried out to analyze the data, using qualitative and quantitative approaches. From this process, the researcher can conclude that there is an evident need to propose the reform project to the Civil Code to avoid further rights violations. |
