La tenencia y porte de armas de fuego y su incidencia en la indefensión e inseguridad ciudadana en el Ecuador

This conceptual and legal analysis about firearms possession and carrying, and their impact on defenselessness and citizen insecurity in Ecuador, looks for identify a theory in order to make it lawful, due to organized crime high levels and well-armed, evidenced in Ecuador. In that order Legally objectives were proposed looking for evaluate the Ecuadorian legislation reforming possibility and feasibility, regarding the firearms carrying and possession within Ecuadorian territory, through legal and doctrinal framework analysis and interpretation about the conceptual argument on weapons of fire, firearms classification, possession and carrying, legitimate defense and the current Security Crisis in Ecuador. Carry out a Constitutional, legal and juridical Analysis on the contradictions existence and legal gaps in Organic Comprehensive Criminal Code (COIP)’s article 360, published in the Official Registry Supplement No. 180. February 10, 2014 (Ecuador) and analyze and interpret the juridical inconsistencies and irregularities about obtaining firearms carrying licenses. To develop this research, a descriptive, analytical-deductive study and conducting interviews and surveys were carried out, which will help to propose an Art. 360 Organic Comprehensive Criminal Code reform that deals with the weapons possession and carrying. The legal system, regarding the firearms possession and carrying of, is incongruous, since the Constitution guarantees the human rights in security, the ordinary Law gives broad powers to citizens and the Organic Law limits and prohibits their use.
