La desproporcionalidad de la pena impuesta a los conductores infractores en delitos de transito.

The present thesis takes for title: "The desproporcionalidad of the pain imposed the conductive offenders in traffic crimes", the traffic infractions are of character culposa and they are repressed with sanctions like tickets, reduction of points in the license of driving and exclusive hardships of freedom, the imposition of these hardships bears to the neglect of the principle of proportionality of the hardships preceptuado in the Art. 76 numeral six of the Constitution of the Republic of the Ecuador, when being imposed the offender three sanctions by oneself fact, being exceeded of the principle of humanization of hardships, and stiller of the exclusive of freedom than it is of it finishes ratio should modify the current Organic Law of Terrestrial Transport, Traffic and Security Vial, or in turn the régime of infractions of traffic tipificados in the Code Organic Penal Integral that he/she will enter in validity in the month of August. On the other hand it is necessary to know the motivation form that he/she carries out in judge to apply the healthy one it criticizes in the sentences and to impose the sanctions in traffic crimes. The theoretical, juridical and doctrinal storing, the study of cases, the application of surveys and interviews, it allowed me to obtain approaches with clear and precise foundations, of very grateful bibliography that you/they contributed to the verification of the objectives and the contrastación of the outlined hypothesis.
