| Sumari: | This thesis constitutes the final report of the investigation process carried out and legally motivated in the Ecuadorian legislation, the same one entitled "THE LACK OF AFFILIATION OF WORKERS IN RELATION TO DEPENDENCE AND THEIR PENALTY WITH DEPRIVATION OF LIBERTY UNTIL IT COMPLIES WITH THIS EMPLOYER'S OBLIGATION" whose purpose and importance is to analyze the application and sanction to the contravention against the right to work, framed within the national legislation in force, as it is in the Constitution of the Republic of Ecuador. In addition to international standards such as the Universal Declaration of Human Rights and the comprehensive Penal code, specifically regarding the lack of affiliation to the Ecuadorian Social Security Institute, of arise who does not enroll his worker, violates the human right to Social security, creating uncertainty exposing him to the helplessness in the face of the typical work risks of each job, occupation or trade and even to against the life of the workers and to the helplessness of his Families, I consider it of importance penalize this behavior in the proposed way. I consider it necessary to reform article 244, of the Integral Penal code, in order to guarantee for the protection and safety of workers not affiliated with their employer, thus providing the enjoyment of a dignified life and good living guaranteed in the standard Supreme of the Ecuadorian State. |
