El reclutamiento de niños, niñas y adolescentes por bandas criminales para el cometimiento de actos delictivos como vulneración de su desarrollo integral

The following research work entitled The recruitment of children and adolescents by criminal gangs for the commission of criminal acts as a violation of their integral development has been developed as a result of the increase in involvement of minors in criminal activities as a result of their involvement in the criminal world. Nevertheless, criminal organizations have been established in Ecuador for many years which have been able to include minors in their ranks since years ago. It is evident from the study conducted that criminal gangs recruit minors primarily because they are unaccountable; furthermore, statistical data and case studies indicate that the lack of attention by the State to marginal urban areas has resulted in a significant increase in the recruitment of minors, since the latent need to improve their living conditions ends up leading them to become part of criminal organizations. In the following work on Curricular Integration, materials and methods were applied that allowed the opportune development of the investigation. Using the technique of a survey, thirty professionals of the law were surveyed and five experts in the area were interviewed, including Judges, Prosecutors and the Director of the Center for Adolescent Offenders. The obtained results served to direct the proposal of legal reform to the code 369. 1 of the Organic Integral Penal Code to increase the prison sentence imposed on those who recruit minors, as well as the reform of number 3 of article 393 of the Code of Childhood and Adolescence in order to compensate the damage caused, where through individualization by levels it is possible to reeducate and reintegrate the adolescent offender into society.
