| description | The preeminence that in our criminal legal system has been given to the production, commercialization and possession of cannabis, is nothing more than the result of the enormous criminalization of the freedom of the individual whose consequences have been fatal for societies stuck in a repressive penal system and lacking punitive rationality, unleashing a perennial war between criminal drug trafficking organizations, which, far from weakening them, has been strengthened with a backward legal system, let us remember that the high rates of prison population are due to crimes of micro drug trafficking, revealing the fatal criminalization and the scant proportionality of the penalty with respect to this crime, since it only has people who are used as instruments for the commercialization of drugs by the large drug trafficking mafias, while the latter are strengthened and expanded in the international black market, with a great offer, not only cannabis, opening an addiction portal whose public health problem represents really harmful and even fatal effects in relation to the use of cannabis. It is so through this research it gets to know affectations that has the prohibition of this substance and how it affects the public health systems and to the public safety at a time to study the different legislation that have regulated market cannabis as premise to fight against the power drug trafficking of it and the importance of our state assume responsibility to apply a regulation of cannabis be inclusive and lead information and timely and adequate education so that society knows and understands the benefits and risks of the use of cannabis together with respect to the rights of patients and users who get benefits from the plant. |

It is so through this research it gets to know affectations that has the prohibition of this substance and how it affects the public health systems and to the public safety at a time to study the different legislation that have regulated market cannabis as premise to fight against the power drug trafficking of it and the importance of our state assume responsibility to apply a regulation of cannabis be inclusive and lead information and timely and adequate education so that society knows and understands the benefits and risks of the use of cannabis together with respect to the rights of patients and users who get benefits from the plant.La preeminencia que en nuestro sistema jurídico-penal se le ha dado a la producción, comercialización y tenencia del cannabis, no es más que el resultado de la descomunal criminalización de las libertades del individuo cuyas consecuencias han sido fatales para las sociedades estancadas en un sistema penal represivo y carente de racionalidad punitiva; desencadenando una guerra perenne entre organizaciones criminales de narcotráfico, que lejos de debilitarlas se las ha fortalecido con un sistema jurídico retrógrada; recordemos que los altos índices de población carcelaria obedecen a delitos de microtráfico de drogas, develando la fatal criminalización y la escasa proporcionalidad de la pena con respecto a este delito, ya que únicamente hacina a las personas que son utilizadas como instrumentos para la comercialización de drogas por parte de las grandes mafias de narcotráfico, mientras están últimas se fortalecen y se expanden en el mercado negro internacional, con una gran oferta de drogas, no solo cannabis, abriendo un portal de adicciones cuya problemática en materia de salud pública representa efectos realmente nocivos e incluso fatales en relación al consumo de la marihuana. Es así que, por medio de esta investigación se llega a conocer las afectaciones que tiene la prohibición de esta sustancia y cómo afecta a los sistemas de salud pública y a la seguridad ciudadana.
