REFORMAS AL CÓDIGO ORGÁNICO INTEGRAL PENAL, RELACIONADA CON EL TIEMPO DE PRUEBA PARA ASEGURAR EL DEBIDO PROCESO Y LA LEGITIMA DEFENSA PARA QUE NO QUEDEN EN INDEFENSIÓN LOS LITIGANTES EN LAS CONTRAVENCIONES DE TRÁNSITO

This work corresponds to a feasibility study aimed at the doctrinal legal research regarding the term test find provided in the rule governing traffic infringements, such as Comprehensive Organic Code of Criminal Procedure, this in order to provide a broader vision at all interested in this issue and legal scholars on this particular criminal legislation and specifically traffic violations. The study begins with an introduction, after an analysis of concepts and doctrine focused on the title of the thesis is carried out, a reference to the controversial doctrine study analyzing the legal institution of the challenge regarding traffic violations, then it performed focus on the legal term outlook given test in COIP and the opinion of the doctrine about it, ending the doctrinal part with the principles of focus certain procedures in COIP, then we focus on studying the constitutional part verifying the principles that may be affected by the rules governing the term test contraventions transit, is the principle of presumption of innocence, due process. Finally in the last part of this section we will see a case study to illustrate we verify the problem and comparative legislation to be analyzed for the purpose of checking our delay advance or guarantees regarding the right of citizens concerning violations of transit.
