The prevention rules correspond to one of the biggest contribution of the labor right , which is looking to reach a just justice, because they prevent the workers' interests , but according the Work Judgers they are conceded with the judgment, these result ambiguous thaf s why they are ¡nefficient. The negative aspect of this legal disposition is don't apply the prevention rules with initial demand, after that or with given evidence to the process, we must wait for a judgment in order to use them. In this space of time, thaf s it from the acceptation of the demand to the judgment., there will be a lot of situations, because of lack of guaranties in the application of the prevention rules ; situations detected in the practical life, thaf s the case , the employer expand in a not intentional way the process , in order to oblígate to the worker , due his/her economic need , to resign , militating his/her rights; or in other cases, when the employer is considered defeated the judgment . he sells or transfers in fictitious way their properties or he travels to other country avoiding a responsibility, with this he is searching his no good propose, leaving without defense to the humble worker , because the prevention rules as the prohibition , the kidnapping, retain or the root there weren't taken in their opportuníty. Our investigation is oriented to determine with precisión:: a). The Ecuadorian labor legislation, it doesn't have a good processed system for the labor demand ñor only to have e success, it's importaht that this success is assure in favor of who is asking for justice b). The prevention rules don't have a positive effect in the juridical results in the labor matter; c). The actual labor normative with respect to the prevention rules contradict with the constitutional norm respect to the renounce of the workefs rights; and, d). The absence of the fit and effective procedure produces juridical insecurity. In the given dimensions, it is oriented in a clear and objective way the central problem of the investigation.

Las medidas precautelatorias en materia laboral como: la prohibición, el secuestro, la retención y el arraigo, al ser aplicadas con la sentencia condenatoria, así no estuviere ejecutoriada, no surten los efectos jurídicos anhelados por la clase trabajadora, vulnerando de esta manera injustamente sus derechos constitucionales y legales, particularmente en sus aspectos económico, familiar y social. Las medidas precautelatorias corresponden a uno de los grandes aportes del derecho laboral, que buscan alcanzar una justicia equitativa, ya que precautelan los intereses del trabajador, pero conforme los Jueces de trabajo las conceden con la sentencia, éstas resultan ambiguas lo que hace que sean ineficaces. Lo negativo de esta disposición legal es justamente no aplicar las medidas precautelatorias con la demanda inicial, posterior a ella o con pruebas aportadas al proceso, sino que debemos esperar que exista sentencia para recién hacer uso de ellas. En este espacio de tiempo, es decir, desde la aceptación de la demanda hasta la sentencia, pueden suscitarse muchas situaciones, por falta de garantías en la aplicación de las medidas precautelatorias; situaciones que han sido detectadas en la vida práctica, tal es el caso, que el empleador dilata mal intencionadamente el proceso, con el fin de obligar al trabajador, debido a su necesidad económica, a resignarse, limitando el monto de sus derechos; o en otros casos, cuando el empleador se considera vencido el juicio, procede a la venta o enajenación ficticia de sus bienes o se ausenta del país evadiendo una responsabilidad, con lo cual alcanza su mal intencionado propósito; dejando indefenso al humilde trabajador, ya que las medidas precautelatorias como la prohibición, el secuestro, la retención o el arraigo no fueron tomadas en su oportunidad. Mi investigación se orienta a determinar con precisión: a). Que la legislación laboral ecuatoriana, no dispone de un sistema procesal adecuado para que las demandas laborales no solo tengan éxito, sino que este éxito esté asegurado suficientemente a favor de quien exige justicia; b). las medidas cautelares no surten un efecto positivo en los resultados jurídicos en materia laboral; c). La normativa laboral vigente respecto a las medidas cautelares se contradicen con la norma constitucional respecto a la Irrenunciabilidad de los derechos del trabajador; y, d). La ausencia de una normativa procedimental adecuada y eficaz produce inseguridad jurídica.
