| الملخص: | Although the Constitution of the Republic of Ecuador guarantees the labor and union rights of workers, giving them the category of inalienable and intangible, in case of doubt the Indubio pro-worker principle will be applied. However, the Plenary Session of the National Court of Justice of Ecuador has issued the triple reiteration ruling dated July 8, 2009, published in official record 650 of August 6, 2009, which prescribes that the term of The duration of a collective contract determines the validity of its legal effects without it being considered that a contract of this nature can be understood as of indefinite duration, which violates the inalienable and intangible rights of workers, as well as the rights of progressivity and non- regression. In this research, the emergence of unionism in the international context, as well as in Ecuador, was analyzed. The collective contract and its classifications, the constitutional guarantee of union rights, the supremacy of the constitutional norm were reviewed; the role of the International Labor Organization. An analysis was carried out on the background of the triple reiteration ruling issued by the Plenary Session of the National Court of Justice, to conclude on the legal, economic, social and family effects that this Triple reiteration ruling has produced on unionized workers. To achieve this, the scientific, analytical, exegetical, hermeneutic and synthetic method has been used, using theoretical documentary collection techniques, documentary observation techniques, and surveys. |
