NECESIDAD DE CONTAR CON UN RÉGIMEN JURÍDICO ADECUADO QUE REGULE LOS PROCEDIMIENTOS ADMINISTRATIVOS EN TODOS LOS ÓRGANOS DEL SECTOR PÚBLICO

This research paper entitled "The need for an adequate legal regime governing Administrative Procedures in all Public Sector bodies", refers to a problem that is caused by the dispersion of the legal regime governing the administrative procedure and that there are several legal rules do not establish uniform procedures for the various administrative procedures carried out in different public sector entities; and the Statute of the Legal and Administrative Regime of the Executive Function in his second book contains clear regulations on administrative procedure, but only applies to the Central and Institutional Public Administration of the Executive Branch and the Organic Code of Territorial Organization, Autonomy and Decentralization in Chapter VII, Section Second to Fifth, refers to the administrative procedure, where these provisions apply only to agencies that make up the system of autonomous governments. In the absence of uniform administrative procedures to consider the remaining public sector entities are based on the limited contain provisions about the organic laws governing each entity and internal provisions that establish different procedures and sometimes confusing, which goes the guarantee given to have a clear process and equal realization of the right to legal certainty, as the due process rights of those who require follow an administrative procedure for exercising their rights. It is therefore necessary to establish principles, rules, common and general formalities and procedures, which will help to ensure that the managed exercise their rights and adherence to law in the actions of the Public Administration of our Country.
