Riassunto:The evaluation of the efficacy of environmental legislation in mitigating climate change, particularly in relation to the oil activities and the greenhouse effect is crucial for Ecuador due to its economic dependence on the exploitation of natural resources and the associated environmental challenges. The objective of the research was to evaluate the efficacy of the environmental legislation in Ecuador in mitigating climate change, focusing specifically on the greenhouse effect generated by the activities of oil companies. To analyze the legal framework, the policies and strategies implemented by the oil companies, and the barriers in the application of these regulations, different methods were used such as empirical, descriptive, inductive, analytical, exegetical, and maieutic methods, combining a qualitative approach with theoretical and documentary collection techniques and interviews. The results indicate that although Ecuador has a strong environmental legislation (including the 2008 Constitution, the Environmental Management Law, and the Organic Environmental Code), there are significant barriers to its effective implementation such as conflicts of constitutional rights, institutional and budgetary limitations, corruption and lack of political will. Oil companies face challenges in the implementation of these regulations affecting climate change mitigation. The study concludes that even though the legal framework of Ecuador is adequate its effectiveness in mitigating climate change is compromised by multiple operational and structural challenges. It is recommended strategies to strengthen compliance with environmental legislation and improve its efficacy in mitigating climate change, ensuring sustainable and balanced development between the economy and environmental protection.
