Análisis jurídico y jurisprudencial de los derechos vulnerados y de los vacíos legales de la sentencia de impugnación de paternidad nro. 19332-2021-00059.

The present research work entitled, “Legal and jurisprudential analysis of the violated rights and legal loopholes in the paternity challenge ruling no. 19332-2021-00059”; Its purpose is to be able to determine certain situations that are found in the institution of paternity challenges, it will also know the rights that are violated both of the minor and the alleged father, which are found mainly in the Constitution of the Republic of Ecuador, as well as the importance of DNA (deoxyribonucleic acid) evidence in this type of trials. It also consists of being able to understand and understand the difference that exists between the challenge of paternity and the challenge to the act of recognition of paternity, since on many occasions legal professionals and administrators of justice confuse these two figures, this will be done guiding us from what the Civil Code establishes. For the preparation and relevant development of this work, several research parameters have been established, such as legal, conceptual and doctrinal. The type of research carried out was jurisprudential and doctrinal, in addition the necessary methods were used such as: inductive, deductive, analytical, exegetical, maieutic, comparative, statistical and also synthetic. And as for the field study, techniques such as surveys and interviews are applied from which the criteria of professionals and specialists in civil matters could be obtained, in order to verify the problem posed and be able to determine possible solutions.
