Tóm tắt:The importance and transcendence of the social-juridical problem denominated Contradiction between the Organic Code of Production, Trade and Investments, and the Constitution of the Republic of Ecuador, in the solution of conflicts by international arbitration, is directed fundamentally at the need to dissolve the doubts ofgovernment and privates entities, in the matter of using international arbitration, an alternative standardto solve these conflicts, which can be used efficiently and with totally legal safety at the moment of its request.This is because the specific moment of need obligates us to study the law thoroughly. At the time of investigating this theme, we find a contradiction between the Ecuadorian Constitution and the Organic Code of Production, Trade and Investments, because at the constitutional level the types of trade and investments we will look at are forbidden, but permitted at theorganic level,demonstratingthe lack of compatibilitybetween the Law and the constitutional juridical framework. This provides us with the centralpoint ofinvestigation, whichrequires full legal attention. The theoretical work and fieldwork of this thesis allowed me to develop views on this theme with clarity and strong reason, echoed by an extensive andwell-known Bibliography, that helped me to verify my objectives, and illustrate the contrast between the constitutional law and the organic law in the Hypothesis expounded, leadingto the proposals put forward in my thesis. The thesis contained is an intellectual effort from the applicant within the scientific and methodological field, to embrace theoretically and empirically the limitations at the request ofan international arbitration, like the attempt to use these alternativemethods to solve the contractual conflicts between a foreign investor and the Ecuadorian State.This situation is forbidden in the Ecuadorian Constitution, and made more difficult by the factthat all lower Contradicción entre el Código Orgánico de la Producción, Comercio e Inversiones y la Constitución de la República del Ecuador, en la solución de conflictos por medio de Arbitraje Internacional” hierarchy laws need to stay in harmony with the Constitution. If the Organic Law does not conform with the constitution,possible legal disputes can follow, producing something of a heavier legal problem that is the lack of juridicalsafety by the Ecuadorian side with an international investor.This highlights the necessity to reform the Organic Law to prevent legal paradoxes.
