Summary:This study aims to analyze the regulation of surrogacy in Ecuador. The main objective of this research was to examine the impact of recognizing and regulating the labor aspect of surrogacy in protecting the reproductive and labor rights of the surrogate mother. Descriptive, interpretive, and comparative methods were used. The sample consisted of 92 participants, 50 women and 42 men. The results indicate that legal professionals believe there is a need to regulate surrogacy as a form of employment with rights and obligations. Furthermore, based on the findings, there is a need to create a specific law that ensures and protects the rights of pregnant women and the reproductive rights of surrogate mothers. From this, we conclude that it is essential and necessary for Ecuadorian law to establish a stringent legal framework to regulate surrogacy and clearly define the roles, responsibilities, and guarantees of reproductive rights for all parties involved.
