Las pensiones provisionales de subsistencia fijadas en las controversias de violencia intrafamiliar, en la Legislación Ecuatoriana

This research work, I have developed in the legal field of public law, specifically the shortcomings that exist in the Criminal Code of Integral regarding precautionary and protective of offenses of violence against women or members of the household measures. Women and all members of the family are the fundamental unit of society, which must be protected as a priority; is why, nowadays the State to each and everyone of its members must contribute to enforce their rights, especially in the framework of equality and fairness, encouraging nondiscrimination of its members. When referring to the precautionary and protective of offenses of violence against women or members of the family, specifically in the setting of living allowance measures, I would say that there should be parameters for fixing it with the order to achieve a better realization of justice. Thus, our Constitution as a principle of immediate application establishes as one the primary goals of the State, the realization of justice in harmony with the good living of all Ecuadorians; as such, it must be stated more clearly the purpose of the Act, in order to effectively achieve its purposes sense. As such, this research establishes clearly and precisely how they should fix the living allowance for handicapped persons under the Comprehensive Penal Code; since there are no exact parameters for fixing the pension and further to run
