LA CONSIGNACIÓN VOLUNTARIA PARA EL CUMPLIMIENTO DE UNA OBLIGACIÓN ALIMENTICIA HACIA UN MENOR ES UNA NORMA Y PRÁCTICA LEGAL QUE ATENTA CONTRA LOS DERECHOS FUNDAMENTALES Y DEL BUEN VIVIR DE LAS NIÑAS, NIÑOS Y ADOLESCENTES EN EL ECUADOR

Food is defined as the provision of economic order to which they are required by law certain economically qualified people for the benefit of certain needy and unable to procure such means of life for themselves, in order to meet the needs more pressing its existence. Within this definition they fall the necessary resources for the subsistence of a person, taking into account not only their basic needs like the word organic feed seem to suggest, but also the means designed to allow a decent existence, including parameters such as feed requirements and the required economic and domestic circumstances. The important thing about these legal developments we have described and considered as such, the food is not limited to the basic benefit to food, food intended strictly as such, but this law goes much further, considering the satisfaction of all the basic needs of the rightholder, that is, safe and nutritious food, education, health, adequate housing, clothing, help in case of permanent disability; and, in general, all areas to ensure a dignified life, at the level that has unfolded the feed. Unfortunately these laws, have become dead letter at the ignorance of the claimant, and vividness to owe maintenance to the lack of proper advice from lawyers and dysfunctional judiciary, to be opt for this alternative, voluntary provision to prevent the trial which would be analyzed in detail the monthly income of the obligor and the real or even special needs children will need it. Undoubtedly appropriation voluntary alimony is a form of violation of the right to a good life fed as many times the amount to be reported is lower than that established in the table of alimony established by the Council Judiciary
