Description
Summary:This research was conducted in order to meet the need to analyze the role that legal pluralism and intercultural justice currently play in the systems of justice administration in the country, since in spite of being a transversal axis in the institutionalism and governance systems of Ecuador, the ignorance of these legal institutions has been present in all areas of life in the Ecuadorian society. This contradicts what is stipulated in the Constitution of the Republic, which positions our State as an intercultural and plurinational nation, as well as what is stated in the secondary legislation, which deals with intercultural justice, and establishes the autonomy of the different peoples, communities and nationalities for a development based on their own worldview. For the development of this research, different materials and methods were applied, and interviews were conducted with indigenous leaders from different communities around the country, in order to find out their perception of the acceptance that indigenous jurisdiction has had in the traditional systems of state justice administration. The results served to establish an analysis based on doctrine, jurisprudence and field research on the acceptance of society in general, and of the national justice administration systems, regarding intercultural justice, as well as the recognition of legal pluralism as an institution of the existing justice administration system in our society.
