Přidat tag | Shrnutí: | This legal research Regulation is part of the academic problems of environmental law, in particular the Law on Prevention and Environmental Pollution, Environmental Management Act, Integral Penal Code Ecuadorian research that meets the requirements laid down Academic System of the National University of Loja, which regulates the relevance of the research study legal aspects inherent in matters of positive law, to opt for the law degree from the Courts of the Republic of Ecuador. This research aims to demonstrate that the Law on Prevention and Control of Environmental Pollution and the Comprehensive Criminal Code, suffer from legal failure by not co0ntener in its regulations related to the environmental violations. The theme of this research deals with different aspects of what constitutes the environment, its characteristics, the principles that govern the defense and protection of the environment and its surroundings, the environmental problem in the conceptual field, doctrinal, legal, within the field Comparative Law, in the analysis of the criteria given in the surveys and interviews. So in the conceptual aspect, a conceptual analysis of what constitute offenses against the environment is made, the environment its characteristic features, classification Within the legal framework an analysis of what is done to the Law on Prevention and Control of Environmental Pollution, Integral Penal Code, the Constitution of the Republic in relation to the environment, environmental damage, environmental violations, the environment and its problems in Comparative Law. In the doctrinal aspect views and opinions about what constitutes environmental violations, the historical evolution of environmental law are reviewed. Finally, the subject of the field research formulation comprising surveys, interviews, analysis of results, drawing conclusions, recommendations and proposed legal reform is addressed. The defense of the environment and its surroundings, its constituent elements, threats and environmental problems such as climate change and its consequences in nature, desertification, floods, global warming, agents that damage the environment , erosion, pollution and its agents; waste solids, toxic, pollution of ground water, the atmosphere.
