| Resumo: | The present thesis approaches a problem of a great relevance so much from the social point of view as juridical, because in the Organic recently promulgated Code of the Production, Trade and Investments the promotion of the productive worthy work settles down, through a new regulation denominated “Worthy Wage”, which has for purpose to cover with the basket basic relative of the workers, that which is not completed if the basic unified wage, this fundamental premise is not increased it should be clear to begin an juridical and social investigation of these legal reformations. It happens that the calculation of the worthy wage for a person that perceives the worker's basic unified remuneration in general, according to the salary components that it determines the legal suitable body, skirts the quantity of $ 300 dollars, when the basket basic relative for the year 2012 overcome the $ 500 dollars, then you can evidence that the legal regulation of the worthy wage doesn't allow to cover with the basic basket, although expressed disposition of the Constitution of the Republic of Ecuador exists in its Art. 328. To this some exceptions exist, such as the case that the worker perceives more than the basic remuneration, either for the sectorial charts that it determines the Ministry of Labor Relationships annually or for agreement with the employer, that which with the normative of the Organic Code of the Production, Trade and Investments, it will generate a worthy fluctuating wage being approximately the minimum for the $ 350 dollars, with that which doesn't cover the population's basic necessities. Reason why it is required that the wage worthy of the worker that perceives the basic remuneration is not inferior to the BASIC FAMILY BASKET that determines the National Institute annually of Statistical and Censuses. A legal deficient exists and in the resolutions of Ministry of Labor Relationships that don't allow that the worthy wage, fulfill the purpose that establishes the Constitution of the Republic, as I will indicate in the development of the present thesis. |
