Aplicación de Exenciones en la Afiliación a la Seguridad Social de las personas con Discapacidad, como Garantía del Derecho al Buen Vivir

The present thesis entitled "Application of exemptions in the affiliation to the social security of people with disabilities, such as the law to live", refers to the violation of the laws of security and of persons with disabilities in the field of Social Security, this priority attention group is limited in access to this laws, which has a license for the use of copyright for the affiliation of these laws, because at present the right recognized in the Constitution in favor of this group of priority attention of the application of exemptions in public services. Our legal system in Article 34 of the Constitution of the Republic of Ecuador, has recognized the right to social security as an inalienable law of all people, and will be the primary responsibility of the State, in accordance with Article 7 of the Social Security Law is recognized for disabled persons not affiliated with Compulsory General Insurance will have the character of a social assistance, financed exclusively with the mandatory contribution of the State. I propose as objectives for the realization of a legal and doctrinal study of the rights of persons with disabilities in relation to Social Security affiliation, with the hypothesis proposed to determine the existence of violation of the laws of social and economic inclusion, by not guarantee exemptions in the payment of social insurance for people with disabilities. With the application of the different methods and materials it was possible to determine that in our country, a recognition has been granted in the laws to 5 persons with disabilities, which is an advance, but in the field of social security there is still much to be done. The application of the different techniques, such as the survey and the interview, was fundamental for the reform proposal, which allowed obtaining the fundamental data for the proposal of a reform of the Social Security Law, in which exemptions in the affiliation of people with disabilities to Social Security, in order to guarantee rights, through the conservation or improvement of disability resulting from a better quality of life.
