Further, the State shall formulate and implement policies to achieve equality between men and women. The literal a), paragraph 3 of Art. 66 of the Constitution of the Republic of Ecuador, guarantees people the right to humane treatment, comprising a) The physical, mental, moral and sexual integrity. The Art. 81 of the body of laws invoked, says the law will establish special and expeditious procedures for the trial and punishment of crimes of domestic violence, sexual, hate crimes and those committed against children, adolescents, youth, people with disabilities, older adults and persons who, by their characteristics, require greater protection. Specialized prosecutors and defenders or advocates for the treatment of these causes, according to the law shall be appointed. The Code of Criminal Integral in article 155, referring to violence against women or members of the nuclear family, says violence is considered any action that consists of maltreatment, physical, psychological or sexual executed by a family member in against women or other members of the family. Are considered household members to or spouse, the couple in union or union, partner, parents, children, siblings, relatives up to the second degree and persons with whom it is determined that the processing processed or maintains or has maintained family, intimate, emotional, marital, coexistence, dating or cohabiting relationships. Psychological violence against women or members of the family, refers to the person who causes harm to the mental health acts of disruption, threats, manipulation, blackmail, humiliation, isolation, surveillance, harassment or control beliefs, decisions or actions shall be punished as follows: 1. If minor damage affecting any of the dimensions of the overall functioning of the person in the cognitive, affective, somatic, areas of behavior and relationships, without causing impairment in performing daily activities is caused, shall be punished by imprisonment of thirty to sixty days. 2. If it affects moderately in any of the areas of personal, work, school, family or social functioning that would be prejudicial in meeting their daily activities and therefore requires specialized mental health treatment, you will be punished six months to a year. 3. If causes severe psychological damage that even with the specialized intervention has not been reversed, shall be punished with imprisonment of one to three years. The art. 158 of the Act punishes sexual violence against women or members of the family to whom it is imposed to another and forced to have sexual intercourse or other similar practices, shall be liable to the penalties provided in crimes against sexual integrity and reproductive. Sets equally as contravention of violence against women or members of the household, the person who hurt, injured or hit the woman or household members, causing injury or disability not exceeding three days, shall be punished by imprisonment freedom from seven to thirty days. Although, somehow, on psychological violence briefly referred to acts of humiliation, blackmail, threats, isolation and harassment is not referred to acts perpetrated by any mimbro family to control or limit access to their assets, property or income, the victim, resulting in acts of economic violence and that for purposes of administering justice fairly, must be established by the Comprehensive Criminal Code. As the criminal law is very clear notes that in criminal matters is not applicable to the broad interpretation of the rules, but the strict than it says it tenor. In my opinion I believe that in order to protect the rights of victims of acts of economic violence, defined this as all acts or omissions that affect the economy and livelihoods of women, through restrictions aimed at controlling the entry of economic perceptions, restriction, limitation and / or unjustified denial for economic resources, it is necessary to criminalize economic violence to protect the rights of victims of acts of domestic violence

El Estado la protegerá como núcleo fundamental de la sociedad y garantizará condiciones que favorezcan integralmente la consecución de sus fines, se basará en la igualdad de derechos y oportunidades de sus integrantes. Además el Estado formulará y ejecutará políticas para alcanzar la igualdad entre hombres y mujeres. El literal a), numeral 3 del Art. 66 de la Constitución de la República del Ecuador, garantiza a las personas el derecho a la integridad personal, la cual comprende: a) La integridad física, psíquica, moral y sexual. El Art. 81 del cuerpo de leyes invocado, señala que la ley establecerá procedimientos especiales y expeditos para el juzgamiento y sanción de los delitos de violencia intrafamiliar, sexual, crímenes de odio y los que se cometan contra niñas, niños, adolescentes, jóvenes, personas con discapacidad, adultas mayores y personas que, por sus particularidades, requieren una mayor protección. Se nombrarán fiscales y defensoras o defensores especializados para el tratamiento de estas causas, de acuerdo con la ley. El Código Orgánico Integral Penal, en el artículo 155, al referirse a la violencia contra la mujer o miembros del núcleo familia, señala que se considera violencia toda acción que consista en maltrato, físico, psicológico o sexual ejecutado por un miembro de la familia en contra de la mujer o demás integrantes del núcleo familiar. Se consideran miembros del núcleo familiar a la o al cónyuge, a la pareja en unión de hecho o unión libre, conviviente, ascendientes, descendientes, hermanas, hermanos, parientes hasta el segundo grado de afinidad y personas con las que se determine que el procesado o la procesada mantenga o haya mantenido vínculos familiares, íntimos, afectivos, conyugales, de convivencia, noviazgo o de cohabitación. De esta manera tipifica como delito contra la familia, la violencia física, psicológica y sexual. En cuanto a la violencia física señala que la persona que, como manifestación de violencia contra la mujer o miembros del núcleo familiar, cause lesiones, será sancionada con las mismas penas previstas para el delito de lesiones aumentadas en un tercio. La violencia psicológica contra la mujer o miembros del núcleo familiar, hace referencia a la persona que cause perjuicio en la salud mental por actos de perturbación, amenaza, manipulación, chantaje, humillación, aislamiento, vigilancia, hostigamiento o control de creencias, decisiones o acciones, será sancionada de la siguiente manera: 1. Si se provoca daño leve que afecte cualquiera de las dimensiones del funcionamiento integral de la persona, en los ámbitos cognoscitivos, afectivos, somáticos, de comportamiento y de relaciones, sin que causen impedimento en el desempeño de sus actividades cotidianas, será sancionada con pena privativa de libertad de treinta a sesenta días. 2. Si se afecta de manera moderada en cualquiera de las áreas de funcionamiento personal, laboral, escolar, familiar o social que cause perjuicio en el cumplimiento de sus actividades cotidianas y que por tanto requiere de tratamiento especializado en salud mental, será sancionada con pena de seis meses a un año. 3. Si causa un daño psicológico severo que aún con la intervención especializada no se ha logrado revertir, será sancionada con pena privativa de libertad de uno a tres años. El Art. 158 de la citada ley, sanciona la violencia sexual contra la mujer o miembros del núcleo familiar a quien, se imponga a otra y la obligue a tener relaciones sexuales u otras prácticas análogas, será sancionada con las penas previstas en los delitos contra la integridad sexual y reproductiva. Establece de igual manera como contravención de violencia contra la mujer o miembros del núcleo familiar, la persona que hiera, lesione o golpee a la mujer o miembros del núcleo familiar, causándole lesiones o incapacidad que no pase de tres días, será sancionada con pena privativa de libertad de siete a treinta días. Si bien es cierto, de alguna manera, en la violencia psicológica de manera breve se hace referencia a los actos de humillación, chantaje, amenazas, aislamiento y hostigamiento, no hace referencia a los actos perpetrados por cualquier miembro de la familia que controlen o limiten el acceso a su patrimonio, bienes o ingresos económicos, de la víctima, que se traducen en actos de violencia económica y que para efectos de aplicar la justicia con equidad, deben tipificarse en el Código Integral Penal. Pues la ley penal es muy clara señala que en materia penal no es aplicable la interpretación extensiva de las normas, sino al tenor estricto de lo que dice en ella.
