Итог:This paper prior legal research to obtaining a law degree, analyzes the following problem: "The divorce in our country is a form of termination of marriage due to dissatisfaction and other problems of misunderstanding held by spouses, this legal concept allows spouses den terminate the marriage and being allowed remarriage, the Civil Code in the second paragraph of Article 108 has regulated the procedure of divorce by mutual consent; however, it can be seen that when solving the situation remain the minor children was only established economic status, visitation and feeding of these jettisoned a fundamental part which is the psychological state in which will or by which such children will be spending during the divorce process which causes in children under age consequences both long and short term depending on several factors such as age and sex of the child, giving himself consequences such as depression, guilt, anxiety, even to proceed criminally as to commit suicide, consequently the provision prescribed by the Civil Code has a legal failure because it only expected economic situation of minor children be violated and the right to psychic integrity of children"; which is part of the problematic field of Legal Sciences, so the importance of this research lies in the reality that is observed today when giving effect to a divorce by mutual consent due to the situation in the remaining minor children since the Civil Code precautionary steps to ensure the right and psychic integrity of children and adolescents during these processes so that the above standard has a big flaw is not framed in relation to ensuring the best interests of the child leaving serious consequences for these both short and long term.
