Necesidad de convertir la contravención de trànsito grave de tercera clase dispuesta en el art. 144 lit. “a” de la ley órganica de transporte terrestre, tránsito y seguridad vial en un delito de tránsito

Criminal law is presented as a mechanism to ensure that living within society operates under the guiding principles of law and morality, also appears as a deterrent for those who drive their actions to disrupt this state of harmony. The legal consequences for each of these socially harmful actions, is different depending on the severity they represent in a particular historical moment, as a rule are divided into crimes and misdemeanors , the first more punishment than the latter , in turn exist crimes and violations that are grouped into a bounded law involve acts or omissions common to a given social sector , say and tax offenses , military or financial violations. In this category are crimes and violations of transits contained in the Organic Law of Land Transport , Traffic and Road Safety . Among the many traffic violations are the result of a traffic accident resulting only in property damage whose repair costs go from and to a certain amount of money, the law in question contains an offense punishable the same action as the contravention above , except that in this case the cost of repair must exceed the limit of the contravention . Throughout this research will be explained based way because the mentioned violation does not possess the qualities of background to be considered as such and should be criminalized, demonstrating that in this way you can ensure a process of trial and compensation for damages attached to the Constitution and the law.
