Establecer un solo procedimiento para adjudicar los escaños en las elecciones pluripersonales en la ley orgánica electoral y de organizaciones políticas código de la democracia y reglamentar los casos de empate

At present, this research work has its relevance and importance for the diversity of elections we have had in the last decade and elections looming, it is therefore that under existing regulations, it is important to indicate that with the Constitution of the Republic of Ecuador, the state has five functions and within these the electoral function is divided and in the National Electoral Council and the Electoral Tribunal and specific rule the Organic Law on Elections and Political Organizations Code is Democracy, two kinds of methods of allocation of seats, leading to a confusion of the people in general for not having expertise in the election issue, which I think has generated an inequity for both candidates as set substantially policies at the provincial, cantonal and parochial organizations, which has meant that the elections are diminished their chances, since the methods and procedures benefit large organizations usually occupy the seats by the so-called entrainment or vote for an entire ; and the lack of specific regulations for the procedure in case of ties for allocation of seats, leads to show that there exists a legal vacuum as just typing in case of a tie in the last seat, (Article 165 Code of Democracy) if it is true in this article different forms of deadlock explained but it does not apply when there is a tie in other posts and between a disabled person and a woman, what it is the procedure should circumvent or affirmative action is applied.
