Parents have an obligation to be with the children, care for, protect, feed, educate, ensure their full development, legally represent them and manage their property. In today's society has seen cases of families separated parents either by divorce or by the mere will of the parents, so it is left helpless minors since their custody and care would be granted to only one of parents usually the mother who is responsible for raising their children. Thus a total breakdown of ties and family and emotional relationships between parents and children, seeing this limited way parental rights of the parent who is away from home is generated. It is of utmost importance for the development of children that they maintain close relationship with both parents and although they are separated or live together under one roof. The implementation of the joint custody of children whose parents are separated help promote family unification and strengthen the bond between parents and children. Joint custody directly benefits the minor children who are reared and developed in an atmosphere of trust with each of their parents, which would help to solve existing problems and avoid those that may arise in the future. But with the current legislation it is not possible to implement joint custody since the law gives this right exclusively to one spouse, the same as is in the duty of care and protection of their children. It is therefore important to perform a legal reform to authorize the application of shared ownership towards ensuring the rights of children, they are of public order and priority.
