Necesidad de agregar en el art. 7 de la Ley Orgánica de Empresas Públicas, un numeral donde se incorpore un representante designado por la organización sindical ante el directorio general

The research entitled "NEED TO ADD TO THE ART. 7 OF THE ORGANIC LAW OF PUBLIC ENTERPRISES, INCORPORATED A NUMERAL WHERE AN APPOINTED BY THE TRADE UNION REPRESENTATIVE TO THE GENERAL DIRECTORY "presents an analysis of a problem, which takes into account that the Ecuadorian State must establish public enterprises for management strategic sectors, the provision of public services, sustainable use of natural resources or public goods and the development of other economic activities consists in Art. 315 of the Constitution of the Republic. Considering these arguments, it has created the Organic Law on Public Enterprises, same that regulates the constitution, organization, operation, merger and liquidation of public companies outside the financial sector and act internationally, nationally , regional, provincial or local, and establish mechanisms for economic, administrative, financial and management control to be exercised over them, as provided by the Constitution of the Republic. On the other hand the constitution of the Republic established as one of the principles underpinning the right to work, freedom of association of workers, which can be exercised without prior authorization, this guarantee includes the ability to form unions, guilds or associations. That is why it becomes essential that a numeral is added to Art. 7 of the Law on Public Enterprises where a representative appointed by the union before the general directory, which should have a say to make decisions is incorporated necessary towards safeguarding of the interests of the group it represents. The methods and techniques used in the investigation were: Scientist, inductive method - deductive, analytic, synthetic, also techniques such as observation, study, analysis and legal synthesis which were required by the proposed legal research using the survey to gather the necessary information supporting field research. From which it follows that there is no provision in the Law on Public Enterprises where specified that the union may incorporate a representative to the general directory, so it is necessary to perform the embodiment necessary in Art. 7 of the above law, so that article recommends incorporating the corresponding numeral
