La Adopción prenatal voluntaria frente a embarazos no deseados

This thesis work entitled “THE VOLUNTARY PRENATAL ADOPTION AGAINST UNWANTED PREGNANCIES”, refers to the need to incorporate into the Ecuadorian legislation the legal figure of Prenatal Adoption, as a legal measure of protection the unborn child´s rights, which is favorable for the mother and for the nasciturus and that will proceed in cases of unwanted pregnancies, because of the absence of any legal provision to which mothers who are living the experience of a pregnancy of this type, which is produced by no use or failures of different contraceptive methods or for a violation; women, but specifically teenagers who are the sector that most affects this social phenomenon are forced to be mothers of a unwanted child or to have an abortion. Prenatal Adoption is a measure that mainly protects the nasciturus´s rights, as it constitutes a different alternative to abortion, which is a crime in our country, protects and guarantees your right to life from conception and in the case of mothers who decide to continue their pregnancy, because it is an unwanted child, would prevent the child from living a life full of misery, abandonment, discrimination and abuse. The research work contains conceptual references, doctrinal elements and regulations of a national and international nature, that allowed the understanding of the determined legal problem, resulting in the formulation of a Draft Law on the reform of the Childhood and Adolescence Code oriented to incorporate the legal figure of Prenatal Adoption.
