Necesidad de reformar el art. 560 del Código del Trabajo, para garantizar el cumplimiento de los derechos del trabajador extranjero, que labora bajo relación de dependencia en el Ecuador

The importance and transcendency of the versed partner-juridical problem on: "Necessity to reform the Art. 560 of the Code of the Work, to guarantee the execution of the foreign worker's rights that he/she works low dependence relationship in the Ecuador", and when being analyzed the interest minutely he/she arose to study this thematic one, because to newspaper the infringement of the right of the hard-working foreign is observed that lends its services in companies or private business, as well as its manpower is considered of smaller remuneration by its foreigner condition, being indispensable that the organisms of control of the work, as inspectors in coordination with Migrant's National Secretary, be devoted to supervise these places of works, with the purpose of guaranteeing the foreign worker's labor and social rights; and, you of faithful execution to the labor obligations that he/she has all worker and that they are regulated in the Code of the Work. The theoretical work and of field of the present thesis it allowed me to obtain approaches, with clear and precise foundations on the national and international legal norms that protect the foreign worker's rights. As well as the employment of very grateful bibliography that you/they contributed to the verification of objectives, and contrasting of the outlined hypothesis, allowing to support the changes proposed specifically to the Code of the Work to the Art 560 that he/she makes reference to the work of foreigners. The content of the thesis is an intellectual effort of the postulant in the scientific and methodological environment that approaches theoretical and empirically, the limitation to the labor right of the foreign workers that is not guaranteed by the authorities of the local or national competent work.
