Shrnutí:In this academic project, legal and comparative analysis of the length of stay for persons suffering from mental disorders, permanent and transitory, in the Ecuadorian penal system, it is important to take into consideration that the right to life, health, security, physical and psychological integrity and wellbeing in our Constitution of the Republic of Ecuador and other laws under our Constitution, guarantees these rights. At present, mental disorders have increased due to the fact that every one out of eight people in the world suffer from mental disorders and these people can commit a crime at any time, which is why the justice system applies a security measure, which is why we will focus on explaining the different treatments that people with mental disorders receive in our penal system, especially in the security measures that are applied to these people, using doctrine, jurisprudence, internal legislation and comparative law. Likewise, in this degree project, surveys and interviews were carried out with medical and legal professionals, the results of which were used to implement the legal proposal to the Organic Integral Penal Code with the aim of implementing a certain length of stay for these persons who cannot be prosecuted for mental disorders in the respective psychiatric centres for their adequate mental care, given that these persons are of primary importance, and these psychiatric centres must meet the ideal conditions necessary for proper and adequate care and prevention of new illegal acts (committed by these persons) that endanger society. Therefore, we will also resort to reports, government public policies, protection measures and other mechanisms used to prevent and care for citizens who have been temporarily or permanently suffering from multiple illnesses, granting thema maximum and minimum security measure time according to the specific case of permanent and temporary mental disorder.
