| description | In order to substantiate this research work entitled "Disclaimers purchase of mandatory safety legal and constitutional rights of public servants" I have made on the basis of conceptual analysis, and legal doctrine, following scientific methods, hermeneutical, synthetic, deductive, inductive, comparative and analytical studies, using survey and interview techniques. The paper concludes with a proposal to reform the Public Service Law. The various themes were analyzed from the perspective turning to doctrinal opinion writers recognized in constitutional law as Dr. Miguel Carbonell, and to the Constitution and international human rights treaties, and the comparative study of the rules relevant legal Colombia, Peru and Venezuela. In addressing the constitutional rights, it was possible to demonstrate that public servants character possess inalienable rights such as the right to job security, due process and legal certainty, which can not be disrupted by an executive order under the principle of supremacy constitutional. |

In addressing the constitutional rights, it was possible to demonstrate that public servants character possess inalienable rights such as the right to job security, due process and legal certainty, which can not be disrupted by an executive order under the principle of supremacy constitutional.Con el propósito de fundamentar el presente trabajo investigativo titulado “La compra de renuncias obligatorias, la seguridad jurídica y los derechos constitucionales de los servidores públicos”, lo he efectuado sobre la base del análisis conceptual, doctrinario y jurídico, siguiendo los métodos científico, hermenéutico, sintético, deductivo, inductivo, analítico comparado y estudios de casos, utilizando las técnicas de encuesta y entrevista. El trabajo culmina con una propuesta de reforma a la Ley Orgánica del Servicio Público. Los diversos temas fueron analizados desde la perspectiva doctrinaria recurriendo a la opinión de los reconocidos tratadistas en derecho constitucional como el Dr. Miguel Carbonell; así como a la Constitución de la República y los Tratados Internacionales de Derechos Humanos, y el estudio comparativo de las normas jurídicas pertinentes de Colombia, Perú y Venezuela.
