| Sumari: | Cloud Computing has become a popular model for providing various technological services. However, despite the interest generated there still exists many significant concerns with respect to pre-deployment. In most cases the uncertainty grows due to the lack of data use, that is to say, the information that rests in the Cloud as well as the diminished brokering that exists in contracting these services, given that the user must accept terms that only the provider decrees. For this reason the purpose of this thesis is the presentation of recent findings based on contracts for services and data protection in the Cloud. Consequently, a Systematic Review was conducted on databases pertaining to the IEEE, Scopus, Dialnet, RRAAE and EPI as well as on 141 scientific articles using the protocol as defined by Barbara Kitchenham. As a result, it was possible to select papers whose principal findings were laws which needed to be taken into account with respect to data protection as well as the key points that users should consider before signing contracts. Thus a conclusion was arrived at with respect to the current situation that exists together with the lack of legal frameworks to standardize the use of Cloud Computing and that within Ecuador particularly no specific laws exist at this time. However, there what does exist are some articles relating to Electronic Commerce Law, Intellectual Property Law, Consumer Protection Law, Integral Penal Code and the Constitution of Ecuador, which are indicative but do not in reality establish a protection model for data residing in the Cloud. |
