Sumari:The proposed legal research that wont aims at reviewingOrganic Law for the Regulation and Control of Market Power, the same that was published in the Official Gazette No. 555 of October 13, 2011 is; in a first perspective it appears in the Ecuadorian legislation as a Competition Law containing mainly two groups of rules that generally have become global in separate legal texts: "A) Rules of Competition, and; b) Standards sanctioning unfair competition. In both cases the legally protected interest is the Competition" The background that I consider important before treating the problem lies in the first part of Article 1 of the law, which contemplates the three mechanisms are there right from competition with the ultimate goal of protecting the market and through this protection, protecting the interests of consumers and users; and which some inconsistencies arising in relation to free market competition; Art. in question reads: Art. 1. Purpose.- The object of this law is to avoid, prevent, correct, eliminate and punish the abuse of economic operators with market power; prevention, prohibition and punishment of collusive agreements and other restrictive practices; control and regulation of economic concentrations; and prevention, prohibition and punishment of unfair practices, seeking efficiency in the markets, fair trade and general and of consumers and users, for the establishment of a social economic system, solidarity and sustainable well-being
