Resumo:In the face of the environmental impacts that the Tsáchila nationality suffers from agro-industries located on the banks of the Peripa, Pove, and Chiguilpe rivers, supported by state models oriented toward “sustainable development”. This research aims to make the environmental degradation needs known and addressed by the Ecuadorian government. In this sense, legal proposals for solutions for effective environmental justice are put forward. Therefore, this line of research is transversal because it shows the analysis at a specific time, to obtain a snapshot of the characteristics or variables of interest in terms of the rights of nature. In addition, the lack of regulatory laws in Ecuador has allowed companies to establish themselves—under conditions that are not pertinent to their operation—next to the province of Santo Domingo ́s communes. Resulting in a negative environmental impact that is difficult to repair or cease. Thus, the focus was on how indigenous peoples and nationalities have made giant steps in recognizing collective rights and defending territories. Hand in hand with recognizing rivers as subjects of rights and having a water treatment that does not destroy the vital cycle of the rivers already mentioned above.Finally, this research has a sample of data collection and the information contained in primary sources of the investigation, for which interviews were applied to professionals in the field and leaders of the affected communities.
