الملخص:The Art. 39 of the Constitution of the Republic of Ecuador, the State shall guarantee the rights of young people and promote the effective exercise through policies and programs, institutions and resources to ensure and maintain permanently their participation and inclusion in all areas. In addition to young people is recognized as strategic actors of development of the country and promote its incorporation to work in just and dignified conditions, ensuring access to first employment and promoting entrepreneurship skills. Among one of those rights and that many young people want access, is to have a decent job, with the addition of first employment as being people who do not have work experience, are not taken into account by many public and private institutions, and especially the latter, where employers require that these people have a type of work experience requirement is difficult to enforce because of their age have not worked in a particular institution where they recommend with a certificate of work experience . The Labour Code regulates access to employment of minors, women, apprentices, but nothing regulates access to the first job that recognizes the Constitution, legal uncertainty is caused by the absence of clear rules to make viable the recognition of these rights to young people. Recognition for young people to their first job is a right constitution social, for they are in a position of inequality against people who have work experience that should be directed to a framework of a development model where employers to provide them hire people who do not yet have work experience, is the production incentive and ensuring competitiveness of production systems in which a minimum level of protection of young people is placed in a situation of decent work and stable, and the incentive allows the creation of jobs
