Резюме:The new Law Amending the Land Transport Act and Road Safety reflects a new way of penalties on offenders, the reduction system or loss of points for each offense by the driver, the same that are valid for five years, and are awarded with 30 points, stiffen penalties respect forcing traffic legal standards. Traffic law published in the official # 1002 dated August 2, 1996, legal body that provides for penalties of imprisonment and fines for drivers who violate the law, in the government of Rafael Correa, was a change in the legal framework of traffic law, the Assembly considering that there was no real policy in the field of Land Transport, to ensure the safety and mobility of citizens, it is necessary to have a technical law that regulates such aspects Comprehensive Land Transport, Traffic and Road Safety, as the previous traffic law does not provide for preventive standards, issuing the Land Transport Act, Road Traffic and Safety, published in Official Gazette 398 dated August 7 2008, and the General Regulations published in the registration application Official # 376 dated June 3, 2009. The Organic Law of 2008 provides scores for driver's licenses, also involves social actors previously not subject to sanctions, causing reactions from the drivers, and society. The Organic Law of Land Transport, Traffic and Road Safety, provides that pedestrians should be punished financially for breaking the law and committing traffic violations and deprived of their freedom they are responsible for traffic offenses. Then with the creation of the new Organic Law of Land Transport, Traffic and Road Safety, we observed that in Article 145 paragraph "e", there is an exaggeration in the penalty for speeding, since it is sanctioning three penalties for the same violation, as is "fine a unified basic salary worker usually three days in jail and loss of 10 points on the driving license", which must be reformed because it goes against the rights Constitutional such as "not to be tried more than once for the same cause and matter."
