| Summary: | The present Degree Work denominated: "Legal and comparative analysis of the registry of rapists and sexual aggressors in children and adolescents in educational centers", the interest arises in investigating the notable need to incorporate the registry into our legislation, being a system suitable for the proof of people who have been sentenced for sexual crimes and who at the time of requesting or admitting a position in educational centers or spaces related to children and adolescents and even female teachers. The draft Law for the Ecuadorian Registry of Rapists and Sexual Offenders in 2019 proposed by Assemblywoman Lourdes Cuesta, approved in two debates and unanimously by 110 legislators, outlined in ten articles that create a registry that will be managed by the Ministry of Government, which will contain information from the Council of the Judiciary, in the same way from the National Secretariat of Persons Deprived of Liberty, being that the people who have committed sexual crimes will be disqualified from directly engaging in activities with minors, having to present a certificate of not being disqualified to apply for positions or activities near children and adolescents. According to the Ministry of Education, between 2008 and 2017, 919 complaints of sexual violence have been registered in educational establishments, of which 51%, that is, 469, were made by teachers. In the same year, a presidential objection was presented by Mr. Lenín Moreno (the year 2019) objection to articles 1, 2, 3.4, 5.6, 7, 9 , and 10 of the Ecuadorian Registry of Rapists and Sexual Aggressors of Boys, Girls ,and Adolescence since it contravenes regulations of the Constitution of the Republic of Ecuador (Articles 11.2; 201; 202; 203.5; 3.1; 66.4), of which the Constitutional Court of Ecuador in December of the same year resolved the unconstitutionality of said project and post file. In the present research , materials and methods were applied that allowed the development of the investigation, likewise, interviews and surveys were carried out with legal professionals, the results obtained served to propose a legal analysis and compared the Registry of Rapists ,and Sexual Aggressors in Boys, Girls and Adolescents. |
