Etiketa erantsi | Gaia: | This thesis work, entitled "THE NEED TO ESTABLISH A PROVISION THAT CONTEMPLATES A PECUNIARY SANCTION TO THE RECURRING OBLIGATED PARTY WHO FAILS TO PAY CHILD SUPPORT FOR A PERIOD OF ONE YEAR OR MORE" is focused on the search for a feasible and equitable solution to guarantee the rights of girls, boys and adolescents in the main the right to receive food when the person who must provide it is in the necessary conditions to do so but freely and voluntarily fails to fulfill his obligation for a year or more, this right is often violated by the parents of the minor having the intention of not fulfilling their duty, when they are in the necessary conditions to provide food, however, the Ecuadorian justice gives the opportunity to those obliged who could not fulfill their obligation, to request a hearing and give the justifications why they did not comply with the payment of said pensions, but there are rec alcar that for each increase in the ticket that is made to the defendant, the Ecuadorian state invests economically, there being a monetary wear and time in the administration of justice. This problem has been verified and evidenced throughout the conceptual, doctrinal and legal study, it should be emphasized that through field studies carried out with survey and interview techniques it can also be demonstrated that there are shortcomings in our legal system when trying to regulate said situation which is beyond the reach of Ecuadorian justice, concluding that it is important to regulate this situation within the General Organic Code of Processes to guarantee the right to receive food in the terms indicated in said legal body and that this obligation is fully complied with, if Otherwise, a pecuniary sanction of a percentage of the total amount of liquidation is imposed on those who do not comply with the payment of said pensions, having the conditions to do so, however, due to obsession or voluntarily, they do not do so for more than one year.
