AGRÉGUESE AL ARTÍCULO 380 DEL CÓDIGO ORGÁNICO INTEGRAL PENAL “COIP” UN INCISO QUE DIGA: EL CONDUCTOR QUE OCASIONE DAÑOS MATERIALES EN ESTADO DE EMBRIAGUEZ, QUE EXCEDAN LOS TRES SALARIOS BÁSICOS UNIFICADOS DEL TRABAJADOR EN GENERAL, SERÁ SANCIONADO CON REDUCCIÓN DE QUINCE PUNTOS EN SU LICENCIA DE CONDUCIR, TREINTA DÍAS DE PRIVACIÓN DE LIBERTAD Y LA REPARACIÓN INTEGRAL DE LOS DAÑOS CAUSADOS

A long time ago the transit accidents have been visible in our country, they cause the death or injuries to people by intoxicated drivers, this type of infractions have been regulated in the different Codes and Laws as it´s in the Código Orgánico Integral Penal, Ley de Transporte Terrestre; Tránsito y Seguridad Vial, the problem is that in the Código Orgánico Integral Penal doesn´t find typified penalty to the intoxicated driver cause property damage than this exceed the three salaries basics consolidated this must be penalty with reduction of fifteen points in the driver's license, integral reparation of the Damage caused and thirty days of privation of freedom, this isn´t a form only of protecting the property of people, but it would avoid than the same intoxicated drivers cause more serious damage as death or injury to people, I do a question ¿ why do we should wait than an intoxicated driver cause death or injury to one person or more people to be penalty privation of freedom? It`s very clear to some people aren`t agreement with the ideas of penalty to the intoxicated driver it cause property damage it exceed the three salaries basics consolidated of the worker in general with privation of freedom, reduction of fifteen days points in the driver's license and reparation integral de los caused damages, this penalty I propose it is reduction of fifteen points in the driver's license, thirty days of freedom privation and reparation integral of the caused damages. The transit accidents don´t finish in their totality, but if they will reduce in great part.
