إضافة وسم | الملخص: | The testator to grant a will, need the intervention of three witnesses, indicating in this article to be disabilities, including children interdicted, deprived of reason, the blind, the deaf, the dumb, those who have some sentence of four years imprisonment, the dependents of the notary, foreigners not domiciled in Ecuador , and those who do not understand the language of the testator. When analyzing the disabled to witness a solemn testament , to be mentioned as such to the pimps and prostitutes, otherwise seen as a way in which certain people can abuse these provisions to commit their crimes and can affect in most cases the true owners, leading to legal uncertainty, to violate constitutional rights to certain people. The civil law is not taken into account that dishonesty can not be witnesses, prostitutes and pimps. In such circumstances it is necessary to reform the Civil Code Article 1050, for incorporation as unable to witness in a testament to the pimps and the prostitutes, because it affects the trustworthiness that must be saved as witnesses regarding the legality and transparency the testamentary act. |
