Summary:The present research work, called “Analysis of the criminalistic expert evidence and its impact on the legal situation of the defendants in the crime of homicide” is mainly focused on the lack of certainty regarding the adequacy and objectivity of the expert evidence presented, the objective of this legal study is to analyze the legal interpretation and the impact of the criminalistic expert evidence in the crime of homicide in case No. 17247-2013-0070 (K.P.), including the evidence admitted and practiced, and its impact on the legal situation of the defendants. The criminalistic expert evidence that is constantly exhibited in oral trials allows the creation of new scientific methods of discovery, revelation, fixation and obtaining of evidences the analysis of the importance of the expert evidence that meets the standards of impartiality, precision and relevance for making a reasoned decision and attached to the norm. Expert evidence, such as forensic reports and psychological expertise, is analyzed in the development of the theoretical framework. By means of the analytical study at the legal level, it was possible to synthesize conceptually the theoretical statements, at the interpretative level, and reasoning, in addition to this, the methodology used includes surveys, interviews and documentary observation. The modality of the proposed research in terms of its approach: it is of the analytical deductive and descriptive methods type where the characteristics of the variables used are described such as: criminalistics, expert evidence, evidence of criminal expertise, criminalistic expertise in homicide cases, expert evidence admitted and practiced in the specific case No. 17281-2013-0070 (K.P.). Finally, the importance of the judge to adequately assess the expert evidence presented during the process at the time of sentencing, in order to strengthen the reasonable argumentation, is highlighted.
