Having specified the above, the present research work had the objective of determining if the workplace’s harassment figure in the Ecuadorian legal system violates human rights and constitutional guarantees. For this purpose, a theoretical investigation was carried out with a qualitative descriptive approach. The selected methods were deductive and exegetical. To collect data, some research techniques were implemented, including direct observation, content analysis, and the study of judicial judgments. Finally, the gotten results indicate that, despite the ratification of international human rights instruments by the Ecuadorian State to protect workers against workplace harassment, internal legislation does not comply with international standards; since it does not considerspecific sanctionsfor this behavior. In contrast, both Chile and Colombia there are legal provisions that penalize this conduct in the workplace ambit. On the other hand the complaints are more common in the public sector due to specialized regulations, while in the private sector they are limited due to fear of job loss. Consequently, due to the lack of public labor policies in Ecuadorian legislation, it is proposed to introduce workplace harassment as a contravention in the Comprehensive Organic Penal Code; taking into account that in the labor code it appears as a cause for approval in the administrative field.

Abordar esta problemática desde una perspectiva de los derechos humanos en especial para mejorar el bienestar y la integridad de los trabajadores, así como para fomentar un ambiente laboral más equitativo y respetuoso. Expuesto lo anterior, el presente trabajo de investigación, tuvo como objetivo, determinar si la figura del acoso laboral en el ordenamiento jurídico ecuatoriano vulnera los derechos humanos y garantías constitucionales. Para ello se realizó una investigación teórica con un enfoque cualitativo de tipo descriptivo. Los métodos seleccionados fueron el deductivo y el exegético. Para la recopilación de datos, se implementaron diversas técnicas de investigación, entre las que se incluyen la observación directa, el análisis de contenido y el estudio de sentencias judiciales. Finalmente, los resultados obtenidos señalaron que, a pesar de la ratificación de instrumentos internacionales de derechos humanos por parte del Estado Ecuatoriano para proteger a lostrabajadores contra el acoso laboral, la legislación interna no cumple con los estándares internacionales, ya que no contempla sanciones específicas para esta conducta. En contraste, tanto en Chile como en Colombia existen disposiciones legales que penalizan esta conducta en el ámbito laboral; las denuncias son más comunes en el sector público debido a normativas especializadas, mientras que en el sector privado son escasas por temor a la pérdida de empleo.
