| Summary: | This research work entitled "NON-CRIMINALIZATION AND PUNISHMENT OF SEXUAL HARASSMENT STREET VIOLATES CONSTITUTIONAL RIGHTS" responds to a problem by that society is being affected daily and that does not have a legal regulation that allows control and sanction. Through this research we study one of the most common social problems and unnoticed that currently is taking place in the public spaces of our country as street sexual harassment, which is considered a form of violence that is running acts of nature or sexual nature against one or more persons in public spaces and violates constitutional rights such as the right to freedom of movement, right to security, right to integrity. Street harassment is a problem invisible in society and practice goes unnoticed because those who perform such acts considered to be a form of flattery to the people who receive it, but do not consider the damage that their actions may result in the victim as psychological and emotional condition or feeling of insecurity when transiting public spaces as the fear of encountering potential aggressors, etc. Sexual Harassment Street can be exercised in several ways, verbally and nonverbally, by capturing pictures or video recording, with physical contact 5 such as grabs the private parts without physical contact such as exhibitionism, public masturbation and persistent persecution of the individual concerned. In Ecuador is currently regulated sexual harassment as unlawful conduct but such conduct is punishable only when it is the result of power relations, that is, when there is a relationship of hierarchical superiority between the stalker and the victim not when the harassment is conducted in public spaces by persons unknown to him or affected, which is why it is necessary to submit a proposal for legal reform to the Organic Code Integral Criminal considering that this kind of harassment violates rights guaranteed in the Constitution of the Republic of Ecuador .
