| Zusammenfassung: | The Constitution of the Republic of Ecuador as the supreme law, under Chapter II of the rights of the good life in its Art. 26 states that education is a right of people throughout their lives and an inescapable and unavoidable duty of the State . Is a priority area of public policy and government investment, ensuring equality and social inclusion and essential to good living condition. Individuals, families and society have the right and responsibility to participate in the educational process, and there are also related laws such as the Higher Education Act that talk about equal opportunities for Ecuadorians in education. However there are provisions in the latter contradicts legal body such as the art. 80 which in its literal c) says: academic responsibility is fulfilled by regular students and approve the materials or credits of the period, cycle or level, in time and in ordinary conditions set. The latter are not covered or third enrollments, not those considered special or extraordinary, which violates the right to a formal education as it says in the Constitution, sufficient reason to have chosen the theme "NEED FOR REFORM THE ART Charter. 80 OF ORGANIC LAW OF HIGHER EDUCATION BY LIMITING THE RIGHT OF FREE OF PUBLIC HIGHER EDUCATION ESTABLISHED AND GUARANTEED IN THE CONSTITUTION OF THE REPUBLIC OF ECUADOR "because I think it should be reformed such Act as it is inequitable and causes economic harm, psychological and family. Field research I have done through technical survey with a questionnaire of 6 questions applied to 30 legal professionals from the city of Loja, allowing verification of the respective objectives. Once the field research, we proceeded to tabulate the results for later analysis and interpretation by the same set of conclusions and recommendations as well as the proposed reform. Thus concluding my research work, which I believe will provide scientific input for future research both students, teachers and the general public. |
