| Περίληψη: | The Ecuadorian Constitution, approved in 2008, establishes the importance of universal access to information and communication technologies as a fundamental citizen right. The Organic Telecommunications Law, approved in 2015, regulates the telecommunications sector in the country, establishing the conditions for the provision of services, the assignment of radio spectrum, and the protection of user rights. This law establishes the legal foundations and general principles governing the telecommunications sector. However, a general law cannot specify all the necessary requirements for the efficient operation of the telecommunications sector. For this reason, the Regulation of the Organic Telecommunications Law was created, which specifies the technical and operational rules governing the implementation and operation of telecommunications services. This regulation defines the requirements for the installation of telecommunications infrastructures and the assignment of frequencies, etc. The Constitution establishes that the Decentralized Autonomous Governments (GADs), which include municipalities, have political, administrative, and financial autonomy for the management of their competencies and resources, within the framework of the law. In this sense, the GADs have the capacity to create ordinances and regulations within the scope of their competencies, such as land use and occupancy, as well as territorial planning and organization. This work aims to analyze from a technical and legal point of view whether or not there are inconsistencies in Decree No. 10-2011 and its subsequent reform No. 0019-2020 "Ordinance that Regulates the Implementation of Fixed Support Structures for Antennas and their Related Infrastructure for Advanced Mobile Service (SMA)" with respect to the regulations governing the field of telecommunications in Ecuador.
