Čoahkkáigeassu:The present investigation that is presented under the thesis modality refers to a legal problem that deserves to be transformed to overcome the legal- social problem that exists in the State Comptroller's Office as it is a Control body focused on controlling public resources which are designed in the different public entities, in the Organic Law of the General Comptroller of the State in its Article 56 with respect to the determination of civil liability that can be issued within the term of one hundred and eighty days counted from the business day following the notification of the predetermination, this lies in the term established for the corresponding expedition of the resolution of the Civil Liability Culposa; and taking into account that the entity in charge, the State Comptroller General, based on the powers and attributions it has within the process of the government audit, and when detecting the civil liability of public officials and with the aim of complying with all The administrative process carries out the issuance of the Civil Liability resolution extemporaneously with respect to the term of one hundred and eighty days, damaging the state economy and the social system of the Ecuadorian state, by not recovering public funds or assets.
