Označite | Izvleček: | This research work was carried out after making an analysis of Article 345 of the Code of Judicial Function that corresponds to the decline jurisdiction of ordinary justice to indigenous justice, determining main problem problem the lack of applicability of article references. This work stems from the need for compliance with article 345 of the Code of the judiciary regarding the decline jurisdiction of ordinary justice to indigenous justice, to be of indigenous peoples and nationalities to exercise judicial functions according to their customs and ancestral customs. The inductive-deductive, analytical, synthetic, literature, scientific descriptive statistical method was used to conduct this research work. Besides including different techniques were used: the interview survey, the same that allowed the verification of the objectives and the testing of the hypothesis. With the approach of the conclusions and recommendations determined that there is a high percentage of non-applicability of Art. 345 of the Code of Judicial Function, this is because there are no training for judges on the subject. . The various alternatives proposed were performed according to the results shown by field research. |
