Тойм:This research work goes back to conduct a thorough study on alternative ways of solving criminal conflicts, from the analysis of current trends in criminal proceedings, and the use of alternative in our criminal procedure law. In the conceptual basis began analyzing the prospects of a legal nature, the innovative concepts such as conversion, compensation agreements, conditional suspension of the procedure, the simplified and shortened, and the opportunity, especially mediation and its relation to the due process in criminal principle of minimum intervention, the principle of opportunity and the precepts of restorative justice. This also makes the law firm of international conventions on alternative solutions, the institutionalization of mediation in the Constitution of the Republic of Ecuador, and the benefits of its application in criminal proceedings Ecuador, the study of the Law on Mediation and Arbitration and the global expansion of mediation, referring to the study of comparative law and the reality of several countries that have seen the possibility of resolving its internal conflicts through consensual criminal justice, penal policy derived from a restorative and compensatory to the victim of crime. Later proceed to the presentation of materials and methods used in research as well as presenting the legal arguments that support our proposal for legal reform.
