Sumari:The Cantonal Councils for the Protection of Rights, within their responsibilities, directly issue administrative measures for the protection of victims. Nevertheless, in the canton of Zapotillo in this entity, when cases are instituted to prevent and eradicate violence against women, the right to the defence of the accused is not granted, as stated in article 76.1 of the Constitution of the Republic of Ecuador (2008), disregarding due process. In the face of this, the present study sought to establish the need to put forward a reformatory proposal to the Regulations of the Law for Preventing and Eradicating Violence against Women, so that the accused have the right to defence following the due process, for which it was based on the methodology with a mixed approach (qualitative and quantitative), exploratory, descriptive, with the use of empirical, deductive, analytical, historical and comparative methods. To use survey and interview techniques to analyze 45 complaints submitted by women raped in the sector. The results show that the administrative acts handled by the board do not respect the due process with regard to the defence of the aggressor. The conclusions highlighted the proposal for a guide for the granting of administrative protective measures.
