Shrnutí:The present research work, "Legal and Doctrinal Analysis of the Labor Exploitation of Venezuelan Immigrants in the Private Sector of the City of Loja", arises from the need to conduct a study following the events of recent years regarding the arrival of Venezuelan immigrants in the city of Loja. The issue within the city is evident in the form of labor exploitation and violations of the labor rights of Venezuelan foreigners in the private sector. Undocumented workers are entitled to the same labor rights as local workers; however, there is a significant gap on the part of their employers, as they are not given the fair and dignified treatment they deserve, simply because they come from a country facing severe economic and political challenges. This research reveals that Venezuelan immigrants working in Loja's private sector face serious violations of their labor rights. The labor exploitation they endure restricts their access to fair working conditions, such as adequate wages and legal benefits, and exposes them to excessive working hours and precarious work environments. These circumstances negatively impact their physical and psychological well-being, as their working conditions do not comply with legal standards or the expectations for appropriate professional and personal development. In practice, the labor rights of undocumented migrant workers are often violated, resulting in a lack of access to the legal benefits guaranteed by law for employees with formal or regular status. Due to their migratory status, these workers frequently receive wages below the legal minimum, accepting such lower remuneration because it represents an improvement compared to what they earned in their home country. Furthermore, they find themselves in a defenseless position, working excessive hours and facing labor exploitation driven by their necessity, which forces them to accept precarious and hazardous working conditions.
